The original post, below, is still holding up in my mind. Written during the lead up to the 2020 presidential election while Trump was obviously losing ground to Biden's far more professional campaign, we had not even considered any of the abuses and outright criminal action that have taken place since Trump's election bludgeoning at the hand of Joseph R. Biden.

The truth remains the truth though. The American system, once thought to be some genius inception of governance was and remains a list of thoughts about how to govern. It is devoid of true safeguards because any "safeguard" is only as strong as the people who operate it.

For the Republicans the safeguards are useful tools to hold over the Democrats who, still beholden to the ideals they were written on, don't want to be seen as diluting them. This is a notion that has defined the crafting of law over the last few decades.

The first two amendments to the constitution have been altered by extremism in interpretation to the point of absurdity. Freedom of speech has been so liberalized by conservatives that it now gives blanket permission for fraudulent activity. So now we see make believe news outlets pumping massive amounts of disinformation and propaganda out to people with no fears of consequences dispite the hundreds of thousands of deaths they contributed to.

2A has been hijacked by white supremacy to great, but disastrous effect. If 2A was so firmly rooted in individual defense against tyranny who should be more entitled to carry than African Americans who are so targeted by law enforcement members misusing their authority? The truth is there is no constitutional protection for using deadly force in defense against the government. It works if you have a large enough force to win and take over the government. There is no legal argument that an individual can take up arms because they feel the government is oppressing them. They have a right to express and speak out and to peaceable assembly to air their grievances, to run for office and use the courts.

The Republicans and their enabling media are using these two amendments as cover for an ongoing fraudulent propaganda campaign keeping their base enraged and underfoot. Guns have always had romanticized place in history particularly for white Americans, a fact not lost on the Republican party.

This leads us back to the abuses of the Republican party and the fantasy of America's "democratic institutions".

The abuse of the 1st Amendment, the coercive use of the 2nd Amendment, the ignoring of lawful subpoenas and willingness brazenly lie have once again made clear that the genius of the American system is just more folklore. Nothing more than an honor system, America's government is dying at the hands of one side that has no honor, no good intentions and no interest in America or it's traditions. On the other side a party desperately hoping the dream is still alive and trying to keep it going without stepping outside the lines. The good guys, it appears at the moment,  are not winning.

Original Post.

Like so much about America, its core democratic pillars are far less concrete than advertised. Three equal branches that oversee each other...bla bla...

The painful and obvious truth about the "genius" of the founding fathers was the system they put together only worked well when no one tried to test the system. The three pillars of the American Constitutional system stood tall and brutish, until asked to bear weight. Once asked to stand up to task, the system was only as good as the intention of the people entrusted with it. The honor system that held American federal governance together collapsed, immediately when Donald Trump took advantage of Republican leadership's complete lack of honor.

The truth is, no system will ever be immune to the intention of its operators at any given moment. What's more, the current collusion between Trump and senior GOP lawmakers is just the evil twin of the collaboration that is required for any system of government to operate on even the most basic level. The notion that there has to be a constant adversarial relationship between the branches and parties in any governing system holds us back from our potential. There has to be discussion and even disagreements in order to interject new ideas and approaches to dealing with our wide array of current issues. The McConnell model though, is a relic of American corruption. NĂ’ BRANCH, or chamber, should ever have, or perceive itself to have, the authority to deny the others the right to carry out their duties under the constitution. The job of the Senate is to confirm appointments by the executive not deny the executive its authority under the constitution. McConnell's refusal to look at any appointments Obama was constitutionally entitled during his final year was a racism driven abuse of power. That being said, the current abuses by the executive in the DOJ and state department point to the need for joint authority over vital government safe guards. This though takes us back to the current collusion between Trump and the GOP. Answers to preventing this in the future are elusive,  because again the system is at the mercy of the intention of its operators.

So where to go from here? First a reality check. I'm not an American constitutional scholar. I have simply been observing what is going on with dismay if I am to be honest. I also can't claim to be unbiased. Comments regarding the GOP and their lack of honor are clearly conclusions not observations.

The safe guards to stopping a dictator from rising in a democracy is ultimately the people who own that democracy. In America the right of the people to assemble is being eroded where those people are not showing support for the wannabe dictator. There is a growing understanding that Trump is laying the groundwork to contest a Biden victory in November. Sowing conspiracies about mail in voting and outside nations is clearly intended to give excuses for not conceding the election and taking the results to unqualified judges he appointed.

American freedom and global stability hang in the balance. A Trump election coup is Putin's biggest potential win ever. It will give him a nearly free hand to move into Europe.

With Trump now playing his hand and trying to make a case for delaying the election because of a crisis he is cultivating it is more important than ever to have an alert and responsive American public.
